RULES AND REGULATIONS

 

 PREAMBLE

For the general well being of the Cemetery

And not to impose a hardship on anyone,

The following Rules and Regulations

Are hereby adopted.

 

 

GENERAL

 

  1. The Cemetery reserves the right to charge a fee for its services.
  2. The Cemetery reserves the rights to change, amend, rescind, alter, repeal or add to its Rules and Regulations or to adopt new Rules and Regulation without notice.
  3. Special cases may arise in which the literal enforcement of the Rules and Regulations may impose unnecessary hardship. The Cemetery reserves the right, in such cases, to make exceptions, suspensions or modifications. Any such temporary exception, suspension, or modification shall in no way be construed as affecting the general application of the Rules and Regulations or serve as a waiver to the enforcement of the Rules and Regulations. Furthermore, the failure of the Cemetery to enforce a Rule or Regulation does not serve as a permanent waiver to enforce the applicable Rule and Regulation.
  4. The office is open daily Monday through Friday, except Holidays. Times will be posted seasonally. Please call for an Appointment. When necessary, weekend appointments may be arranged.

GROUNDS

 

  1. No trespassing under penalty of law.
  2. Playing of golf, baseball, football, archery, etc. in the Cemetery is not permitted.
  3. Dogs must be on a leash when on Cemetery grounds.
  4. Visitation is limited to daylight hours only.
  5. Vehicles of any description shall be driven at a rate not exceeding 10 miles per hour on the Cemetery roads. No vehicles permitted on any other part of the Cemetery grounds.
  6. A parent or guardian who will be held responsible for their conduct must accompany children.
  7. All contractors or representatives of any company entering the grounds for the purpose of performing work of any description must first submit a Request Form and provide proof of insurance coverage.
  8. The Cemetery must approve all plantings of any and all types.
  9. Enclosures of any kind cannot be planted or placed around the border of lot, grave, monument or marker.
  10. The Cemetery reserves the right to perform or subcontract any and all maintenance on the Cemetery grounds.
  11. The Cemetery assumes no responsibility for any and all memorials, vases, plants bushes, flowers or anything left at a gravesite. When it is necessary that these items be moved or worked around for any reason whatsoever, all possible care and precaution within reason will be exercised for the preservation of same.
  12. Glass jars or tin cans for flower holders are dangerous, as are the digging of holes in the turf. They are not permissible and subject to immediate removal together with contents.
  13. The Cemetery reserves the right to remove without notice all memorials, sills, grave markers of any description, trees, bushes and all other objectionable articles when in the opinion of the Cemetery they become dangerous or are neglected by the owners of burials privileges or their heirs, for which a nominal charge will be made against the lot or grave.

  

SALE OF BURIAL PRIVILEGES

 

  1. Burial privileges shall be sold under contract and fully paid prior to interments and the issuing of a Certificate of Ownership. At the time of purchase the purchaser shall understand and agree to abide by any and all by-laws, Rules and Regulations then in effect or that may be thereafter adopted by the Cemetery.
  2. Owners of burial privileges have the exclusive right to transfer said burial privileges.
  3. All transfers of ownership must be conducted through the Cemetery office.
  4. A percentage, which shall be determined by the State of Delaware, will be set aside from each sale or transfer of burial privileges and shall be put in trust for care and maintenance of the Cemetery to the extent of funds available. Such payment to the fund shall not create in the purchaser or any other person any right in the said fund or principal there of.
  5. The owner of burial privileges, their spouses, children or heirs will have the responsibility to provide changes of address, phone numbers and general contact information to the Cemetery.
  6. The presenter and or bearer of a certificate of ownership or deed will not serve as proof of ownership, all such evidence must agree with the Cemetery records.

 

INTERMENTS

 

  1. Funerals entering the Cemetery shall be under the direction of the Cemetery staff.
  2. All caskets must be incased in a concrete burial vault approved by the Cemetery.
  3. All cremated remains must be protected in an urn-vault or concrete vault.
  4. The Cemetery Interment Authorization and Disposition Permit must accompany the casket or urn.
  5. The Cemetery reserves the right to assume the person whose information appears on the Cemetery Interment Authorization and Disposition Permit is the individual in the casket or urn.
  6. It will be the responsibility of the person who signs the interment authorization to select the grave space to be opened and further indemnify, defend and hold harmless the Cemetery from any and all claims arising from its actions in this matter.
  7. The Privilege to assign grave space or to request no further interments shall belong to owners of burial privileges until death, and then to their spouse, children or heirs. When equality of privileges exists between children or heirs, an affidavit will be required from those desiring to relinquish their burial privileges.
  8. Minimum notice required for grave opening is 48 Hours based on five-day workweek, Monday to Friday.
  9. The Cemetery shall be required to Layout, dig and/or sub-contract all grave openings.
  10. Cremation Services are scheduled at our convenience: we receive cremated remains from all over the country that are to be placed in their family lots. The Cemetery will select the day and time at our convenience and with no chairs, greens, tables or other amenities. A family witness is welcome.

 

MEMORIALS

 

  1. Owners of burial privileges or their heirs have the right to authorize the placement or removal of their memorial, foundation or base. They also have the right to authorize cleaning, repair or execution of an inscription on their memorial. Any and all work must be detailed on the Request Form provided by the cemetery. When more than one person of privileges exists, all must sign the Request Form.
  2. All subcontractors, foundation installers and memorial dealers shall abide by all the rules and regulations of the cemetery.
  3. Errors made by subcontractors, foundation installers and or memorial dealers will be corrected by their employees, as directed by the cemetery. When the cemetery determines that the cemetery is best to make the correction, the subcontractor, foundation installer and/or memorial dealer, shall be subject to the cemetery fees for correction made.
  1. The cemetery reserves the right to locate, survey, lay out, inspect and approve all requests of any kind on cemetery property. These include but are not limited to mausoleums, niches, memorials, foundations, corner markers, benches bases, grave locations, trees, walkways, roads, flowers, shrubs and grades. The Cemetery reserves the right to set fees for its services. A detailed plan and design of all such work must be part of the request.
  2. The cemetery shall charge a fee that must be paid in advance for any and all work to be performed. A price list is available at the cemetery office.
  3. All memorials, lettering, carvings and any other such material and workmanship are subject to approval of the cemetery.
  4. The cemetery reserves the right to set the day and time when any and all work or delivery is to take place.
  5. Only granite and or bronze memorials may be placed on a grave space or lot. Benches are not permitted on lots or grave spaces.
  6. While the cemetery will exercise due care to protect all memorials on any lot or grave space, they disclaim any ownership or responsibility for damages or injury thereto.
  7. The cemetery reserves the right to correct any error that may be made by their employees.
  8. When the digging of a grave necessitates the removal of a memorial and/or its foundation, fees will be charged for the removal and replacement of said memorial and foundation.
  9. The cemetery shall fix and charge a fee for any memorial dropped off and left at the cemetery by common carrier or memorial dealer.
  10. Only one memorial will be permitted on each grave with a minimum size of 2’ x 1’ except for baby markers.NOTE: The Odd Fellows Cemeteries in Smyrna and Camden have graves ranging from 32” wide to 48” wide. Please call for grave information before you order a Memorial.
  11. Monuments extending above the surface of the ground shall only be erected on lots or graves specifically set apart for such monument privileges. Sharon Hills is a Memorial Park, above ground monuments are not in keeping with the original plan of Sharon Hills and are not permitted.
  12. Soliciting memorial sales, the installation of memorial foundations or any other memorial work within the cemetery is not permitted.
  13. The cemetery shall have the right either to correct or to remove any memorial in unsafe condition without notice. In either case this will be done at the expense of the lot or grave owner.
  14. All charges against a lot or grave must be paid in full before a memorial can be erected.
  15. All foundations must be dug to a depth below the frost line and the concrete must be rated at a minimum of 5,000 P S I and consist of Portland cement & fine to coarse aggregates.
  16. Special cases may arise in which the literal enforcement of a rule may impose unnecessary hardship. The Cemetery reserves the right in such cases to make exceptions, suspensions or modifications. Any such temporary exception, suspension or modification shall in no way be construed as affecting the general application of the Rules and Regulations or serve as a waiver to the enforcement of the Rules and Regulations. Furthermore, the failure of the Cemetery to enforce a Rule or Regulation does not serve as a permanent waiver to enforce the applicable Rule and Regulations.
  17. All memorials, including family mausoleums, monuments, markers, benches, vases and flowers are the property of the individual owner. Therefore any damage to same due to weather, acts of God, vandalism, malicious mischief; theft or for any other reason is the owner’s responsibility. Please contact your insurance agency to include your property on your home owner’s policy
